ANDROS WATERSIDE RETREAT TERMS AND CONDITIONS OF SERVICE
Effective Date: December 1, 2025
PREAMBLE
This Agreement sets forth the definitive terms governing the relationship between Andros Waterside Retreat (hereinafter "The Hotel" or "Merchant") and the "Guest", "Customer", or "User" (hereinafter "You" or "Your Party").
Your access to The Hotel’s website, https://www.androswatersideretreat.com/, the execution of a reservation, or the utilization of any Hotel services constitutes your full knowledge, understanding, and unconditional acceptance of this Agreement. If you do not agree with these Terms, you must refrain from using the Website or making a booking.
1. RESERVATION, FINANCIAL, AND PAYMENT POLICIES
1.1 Booking Confirmation
A reservation is definitively confirmed only upon The Hotel's issuance of a unique reservation number.
1.2 Currency and Accepted Payment
Currency: All transactions are conducted in Bahamian Dollars (BSD) or United States Dollars (USD), which trade at parity (1:1).
Payment Methods: The Hotel accepts Visa, MasterCard, Bank Transfers (ACH/SWIFT), and cash. American Express is not accepted.
Bank Transfer Condition: When payment is executed via Bank Transfer, the reservation is considered provisional until the funds have fully cleared The Hotel's bank account. The clearance time is typically 3-5 business days. The Guest is solely responsible for any bank fees associated with the transfer. Refunds for cancellations of Bank Transfer payments may be subject to longer processing times and non-refundable bank fees.
1.3 Incidental Deposit and Authorization
Authorization for Incidental Hold: At check-in, the Guest must provide a valid credit or debit card for a temporary pre-authorization (hold) equal to one night's room rate (or a minimum of $250 BSD, whichever is greater). This hold secures funds for incidental charges, mini-bar usage, or potential property damages.
Release of Hold: The Hotel is not liable for the processing time or any resulting bank fees or overdrafts incurred by the Guest's financial institution upon the release of the hold.
1.4 Card-Not-Present (CNP) Authorization
By providing your card details verbally over the telephone or electronically, you execute a Card-Not-Present transaction and warrant that you are the authorized cardholder. You expressly authorize The Hotel to charge the card for the room reservation and any amounts settled against the incidental hold.
1.5 Third-Party Payment Gateway
All electronic payments processed via the Website or secured for reservations are handled by a third-party payment gateway provider. The Hotel does not directly process or store your complete financial information (such as full primary account numbers or CVV codes). By making a payment, you acknowledge and agree that the processing of payments is subject to the terms, conditions, and privacy policies of the third-party payment gateway in addition to this Agreement. The Hotel shall not be liable for any security breaches or financial losses resulting from the acts or omissions of the third-party payment gateway.
1.6 Eligibility to Contract
By executing a reservation, You represent and warrant that You are at least eighteen (18) years of age and possess the legal capacity to enter into this binding Agreement.
1.7 Taxes, Levies, and Fees
Rates are subject to all applicable government levies. Value Added Tax (VAT) is not charged on our services.
1.8 Incidentals and Final Settlement
The Guest explicitly authorizes The Hotel to charge the credit card provided on file for all incidentals, utilized services, or property damages not settled upon check-out (refer to Section 4.5). The final settlement will occur within 72 hours of check-out. The Guest waives the right to dispute charges for services or items documented as utilized or damaged during their stay.
2. CANCELLATION AND REFUND POLICY
2.1 Standard Cancellation Policy
More than 14 Days Prior: Full refund, less any bank processing fees.
7 to 14 Days Prior: 50% penalty of the total booking value.
Less than 7 Days Prior / No-Show: Forfeiture of 100% of the total booking value.
2.2 Non-Refundable Rates
Bookings confirmed under "Non-Refundable" rates are charged in full at the time of booking and are ineligible for modification or refund.
2.3 Early Departure
Guests departing prior to the scheduled check-out date are not eligible for a refund for unused nights.
3. GUEST ACCESS AND HOTEL PROPERTY RIGHTS
3.1 Check-in and Check-out Times
Check-in Time: 3:00 PM
Check-out Time: 11:00 AM
Late check-out or early check-in is subject to availability and may incur a surcharge.
3.2 Identification
A valid government-issued photo identification (Passport or Driver’s License) must be presented upon arrival.
3.3 Right of Entry and Refusal of Service
The Hotel reserves the unconditional right to enter guest rooms for maintenance, housekeeping, or in case of emergency (fire, medical, security). The Hotel may refuse service, deny entry, or evict any guest who fails to comply with this Agreement, engages in illegal acts, or displays disruptive behavior, without refund.
4. GUEST CONDUCT AND HOUSE RULES
4.1 Occupancy and Visitors
Occupancy limits are strictly enforced. Additional overnight guests must be registered and are subject to mandatory extra person fees. Unregistered visitors are permitted on property only until 10:00 PM.
4.2 Quiet Hours and Conduct
"Quiet Hours" are enforced from 10:00 PM to 8:00 AM. Guests must maintain reasonable decorum. Amplified music is prohibited in all outdoor areas during this time.
4.3 No Smoking Policy
Smoking (including e-cigarettes/vapes) is strictly prohibited in all rooms and enclosed public areas. A $250 BSD cleaning fee will be charged for any violation.
4.4 Pet Policy
The Hotel maintains a strict No Pets policy. Only documented Service Animals trained to perform tasks for a disabled individual are permitted, provided they are declared at booking. Evidence of an unauthorized pet will incur a deep-cleaning fee of $500 BSD and may result in eviction.
4.5 Damages and Liability
The Guest is financially responsible for any damage to The Hotel's property caused by the Guest or Your Party.
4.6 Accessibility and Special Accommodation
Guests requiring special accommodations must notify The Hotel at the time of booking. The Hotel will make reasonable efforts to comply but makes no warranty that all areas of the property are fully accessible due to structural or location limitations.
4.7 Surveillance and Security
For the safety and security of all Guests and staff, The Hotel premises, including but not limited to the exterior entrances, lobbies, hallways, dining areas, and docks, are monitored by closed-circuit television (CCTV) recording devices. By entering the property, the Guest consents to be monitored. There is no surveillance within guest rooms.
4.8 Commercial Use of Property
The commercial use of The Hotel's premises, including but not limited to professional photography, filming, and advertising, is strictly prohibited without the prior written consent of The Hotel Management. Unauthorized commercial activities may result in the immediate removal of the Guest and Your Party from the property.
5. DINING AND SERVICE POLICIES
5.1 Food Allergies and Dietary Requirements
The Guest is responsible for notifying staff of all allergies. Due to the multi-use nature of the kitchen facility, The Hotel cannot guarantee that any menu item is free from common allergens. Food consumption by Guests with severe allergies is undertaken at the Guest's own risk.
5.2 Alcohol Service
Alcohol service is restricted to individuals aged 18 years or older as per Bahamian law. The Hotel reserves the right to discontinue service to any intoxicated guest.
6. SAFETY, INDEMNIFICATION, AND RISK
6.1 Water Activities and Assumption of Risk (CRITICAL)
The Guest acknowledges the inherent risks of a waterside property, including docks and swimming areas. THERE ARE NO LIFEGUARDS ON DUTY. All water activities are undertaken at the Guest’s sole risk. The Hotel assumes no liability for accidents, injuries, or death arising from the use of these areas.
6.2 Indemnification
You agree to indemnify, defend, and hold harmless The Hotel, its owners, and employees from and against any and all claims, damages, demands, and liabilities arising from your negligence or willful misconduct during your stay.
6.3 Valuables and Personal Property
The Hotel is not responsible for loss or theft of cash or valuables left unattended. Found items are held for a maximum of 30 days. Return shipping for found items is solely at the Guest’s expense and risk.
6.4 Force Majeure
The Hotel is not liable for service failure due to "Force Majeure" events, including Acts of God (e.g., hurricanes), government action, pandemics, or utility failure.
6.5 Technology and Website Accuracy
The Hotel reserves the right to correct any technical errors, inaccuracies, or omissions on the Website or booking engine. The Hotel is not liable for service interruptions, outages, or malfunctions related to Wi-Fi or telephone services.
7. GENERAL LEGAL PROVISIONS
7.1 Governing Law and Jurisdiction
This Agreement is governed by the laws of The Commonwealth of The Bahamas. All disputes shall be subject to the exclusive jurisdiction of the Courts of The Bahamas. The Guest waives any right to a trial by jury or participation in a class-action lawsuit.
7.2 Severability
If any provision of this Agreement is deemed unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
7.3 Modification of Terms
The Hotel reserves the right to modify these Terms and Conditions at any time. The Terms effective at the time of booking shall govern that specific reservation.
